Welcome to Blueye Tactical. These Terms and Conditions (“Terms”) govern your access to and use of blueyetactical.com (the “Site”) and your purchase of any products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the site.

1. About Us

Blueye Tactical is a division of Blueye Eyewear Pty Ltd, designing, developing, and manufacturing purpose-built tactical and ballistic eyewear, including sunglasses, goggles, replacement lenses, and prescription lens adaptors, for military, law enforcement, and civilian outdoor use.

2. Eligibility & Account Use

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order on this Site. By creating an account or making a purchase, you confirm that the information you provide is accurate and current, and that you are responsible for maintaining the confidentiality of your account login details. We are not liable for any loss arising from unauthorised use of your account.

3. Products & Product Descriptions

We make every effort to display product information, including ballistic ratings, certifications, and technical specifications, as accurately as possible. However:

• Colours, materials, and minor design details may vary slightly from images shown due to display settings, manufacturing tolerances, or product updates.
• Ballistic and protective ratings refer to the specific testing standards stated on each product page (such as US and European military ballistic impact requirements). No eyewear can guarantee complete protection against all impacts, projectiles, or hazards in every circumstance, and our products should be used in conjunction with appropriate training, other protective equipment, and sound judgment.
• We reserve the right to modify, discontinue, or update any product, including specifications, without prior notice.

It is the buyer’s responsibility to confirm that a product meets the specific certification or compliance requirements of their employer, agency, or jurisdiction before relying on it for any operational or occupational purpose.

4. Pricing & Currency

Prices on the Site are displayed in your selected currency (AUD, USD, EUR, or GBP) for convenience and are subject to change without notice. The currency and amount actually charged will be confirmed at checkout. Prices exclude shipping costs and any applicable duties, taxes, or import fees unless otherwise stated, which are the responsibility of the buyer.

We take reasonable steps to ensure pricing accuracy. If a pricing error occurs, we reserve the right to cancel the order and issue a full refund, or contact you to confirm whether you wish to proceed at the correct price.

5. Orders & Payment

By placing an order, you are making an offer to purchase a product, which we may accept or decline at our discretion (for example, due to stock unavailability, suspected fraud, or pricing errors). A contract is formed only once we confirm your order by email or dispatch.

Payment must be made in full at the time of order through our secure checkout. We accept payment methods as displayed at checkout. All transactions are processed via SSL encryption.

6. Shipping & Delivery

We ship to the regions listed at checkout. Delivery timeframes provided on the Site or at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs processing, or circumstances beyond our reasonable control.

International orders may be subject to import duties, taxes, or customs fees imposed by the destination country. These charges are the responsibility of the recipient and are not included in the product price or shipping cost.

Risk in the goods passes to you upon delivery to the address provided at checkout.

7. Returns Policy

We offer a 28-day return period from the date of delivery. To be eligible for a return:

• The product must be unused, in its original condition, and in its original packaging.
• Proof of purchase must be provided.
• Certain items, including custom prescription lens adaptors and used or worn lenses, may not be eligible for return due to hygiene or customisation reasons.

To initiate a return, please contact us via our Contact page. Approved returns will be refunded to the original payment method once the item is received and inspected. Return shipping costs are the responsibility of the customer unless the return is due to a defect or an error on our part.

8. Warranty

Products purchased from Blueye Tactical are covered by a 1-year warranty against manufacturing defects in materials and workmanship from the date of purchase, unless a different warranty period is specified on the product page.

This warranty does not cover:

• Normal wear and tear, scratches, or cosmetic damage.
• Damage resulting from misuse, neglect, accident, unauthorised modification, or use outside the product’s intended purpose.
• Damage occurring during high-impact events the product was not specifically rated to withstand.

To make a warranty claim, contact us with your proof of purchase and a description of the fault. Valid claims will be resolved by repair, replacement, or refund at our discretion. This warranty is in addition to, and does not exclude, any rights you have under applicable consumer protection law, including the Australian Consumer Law where applicable.

9. Intended Use & Disclaimer of Liability for Protective Performance

Our ballistic and protective eyewear is designed and tested to specific recognised standards as stated on individual product pages. However:

• No protective eyewear can eliminate all risk of eye injury in every situation.
• Products must be used as intended, properly fitted, and maintained in accordance with any instructions provided.
• Blueye Tactical, its officers, employees, and affiliates accept no liability for injury, loss, or damage arising from misuse, improper fitting, use beyond the rated capability of the product, or use in circumstances the product was not designed for.

Nothing in this section limits any liability that cannot lawfully be excluded under applicable law.

10. Export Control & Regulatory Compliance

Some products may be subject to export control laws, trade restrictions, or import regulations in your country. It is your responsibility to ensure that your purchase, importation, and use of any product complies with the laws of your jurisdiction. We reserve the right to refuse or cancel any order where we believe shipment would breach applicable export control or sanctions laws.

11. Intellectual Property

All content on this Site, including text, graphics, logos, product images, videos, and technology descriptions, is the property of Blueye Eyewear Pty Ltd or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or commercially exploit any content from this Site without our prior written consent.
